Effective and Sensitive Case Management

A successful engineering company based in the West Midlands, with no previous HR support in place, had a seriously ill employee who had been absent from the workplace for a considerable period of time. A sympathetic employer, the company had supported the employee throughout the period of absence but now, given the length of time that had passed, was struggling to meet the needs of the business and needed to recruit the necessary replacement skills.


Having contacted Atlas HR, our first move was to meet with the company face to face to gain a full understanding, not only of the long term sickness case but also a detailed understanding of the business in general. Our experienced HR Consultant then provided advice in terms of the next steps and a plan of action was agreed with the company.

Our support involved visiting the employee at home and explaining all of the steps as well as providing all of the necessary paperwork, letters to the employee in gaining consent to access medical information, and writing to a medical consultant to provide details of likely prognosis and capabilities. There were a number of legal obligations that were required. Taking the lead in managing the case, the company was informed at every stage of the process, as was the employee.


Having obtained the appropriate medical information and having considered a number of options proposed by our Consultant, the outcome was that the employee was dismissed on the grounds of medical capability, all within the necessary legal framework, and in a dignified and sensitive manner, without significant costs.

The company was then able to commence with the recruitment of a replacement.
